3. Quotations and Pricing
- All quotations provided are valid for 14 days unless otherwise stated
- Prices are in US Dollars (USD) and are subject to change
- Final pricing may vary based on project scope and requirements
- Additional work beyond the agreed scope will be quoted separately
4. Payment Terms
- A 50% deposit is required before work begins on any project
- The remaining 50% is due upon project completion and before delivery
- For ongoing services, payment is due monthly in advance
- Late payments may incur a 5% monthly surcharge
- We accept mobile money, bank transfer, and cash payments
5. Project Timeline
- Estimated timelines are provided in good faith and are not guaranteed
- Delays caused by the client (late feedback, content delivery) may extend timelines
- We will communicate any delays promptly and provide updated estimates
6. Intellectual Property
- Upon full payment, the client receives ownership of the final deliverables
- Kivu Service Hub retains the right to showcase work in our portfolio unless otherwise agreed
- Third-party assets (stock images, fonts, plugins) are subject to their respective licenses
- Client-provided content (text, images, logos) remains the client's property
7. Client Responsibilities
The client agrees to:
- Provide all necessary content, materials, and access in a timely manner
- Designate a single point of contact for approvals and feedback
- Review deliverables and provide feedback within agreed timeframes
- Ensure all provided content does not infringe third-party rights
8. Warranties and Disclaimments
- We warrant that services will be performed professionally and to industry standards
- Website functionality is guaranteed for 30 days after delivery
- We do not guarantee specific search engine rankings or business outcomes
- Third-party services (hosting, domains) are subject to their own terms
9. Limitation of Liability
Kivu Service Hub shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Damages exceeding the total amount paid for the specific service
- Issues caused by third-party services or force majeure events
10. Termination
- Either party may terminate with 30 days written notice
- We reserve the right to terminate services immediately for non-payment
- Upon termination, the client is responsible for payment of all work completed
- Deposits are non-refundable once work has commenced
11. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the course of business. This includes business strategies, client lists, technical details, and financial information.
12. Force Majeure
We shall not be liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, power outages, internet disruptions, civil unrest, or government actions.
13. Governing Law
These Terms are governed by the laws of the Democratic Republic of Congo. Any disputes shall be resolved in the courts of Goma, North Kivu.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of our services constitutes acceptance of the modified Terms.
